For businesses who are unaware of the of the new act, it is worthwhile spending some time getting familiar with it, as the ramifications from a business and company’s perspective are extremely onerous.
Under the new laws, courts will be able to prosecute companies that fail to prevent an individual's death because of a lack of adequate health and safety systems in the workplace. Courts will look at the management systems and processes in a company or organisation and will be able to prosecute businesses that fail to manage health and safety properly.
The following few questions might prompt action by those businesses who have not already addressed them:
* Do you think your current policy in terms of Health & Safety and Insurance policies are comprehensive enough to meet the requirements of the new Corporate Manslaughter and Homicide Act?
* Do you have any plans to make any changes to the management of the Health & Safety of your employees on company business, e.g driving, in relation to the new Corporate Manslaughter and Homicide Act?
* Has your organisation carried out a corporate risk assessment relative to the new Corporate Manslaughter and Homicide Act?
* Are you confident that there is a suitable audit trail in place within your organisation which meets the new legislation’s requirements?
