Researching the franchise system history we find examples of business practices that resemble the current franchise system since the twelfth century, in London. But, in general, it is considered that the franchise system started in the U.S. after the Civil War, when the sewing machine company Singer established a network of stores that used their brand and resold their products. We must clarify that the franchise system did not result from a moment of inventiveness of a creative person. It emerged and evolved as a solution for entrepreneurs in response to problems they faced related to the desire to expand their businesses while they needed to keep its fundamental characteristics, as well as preferred customers compared to the others. Therefore the development and growth of the system is happening in a natural and ongoing, parallel with the decrease of the geographical boundaries of countries, since the franchise system in its essence is directly related to growth and business expansion.



FRANCHISES IN ACCORDANCE WITH THE LAW

Franchise business is a system whereby a franchiser grants the franchisee the right to use the trademark or patent, associated with the exclusive right to distribute or semi-exclusive to products or services and possibly also the right to use the technology of implementation and business Administration or operating system developed and owned by the franchisor, through direct or indirect remuneration.

TERMS USED IN THE FRANCHISE SYSTEMS

Franchiser: Is the entity that authorizes others (the franchisees) to make limited use of a mark whose rights are involved. In more advanced systems, are also broadcast standards and knowledge necessary for successful operation of the business. The knowledge imparted allows a franchisee to deploy, operate and manage their own business.

Franchisee: The person or entity who purchases a franchise.

Franchise: A unit of a given network.

Territory: Geographical area of operations determined in a franchise contract between the parties, with a guarantee of exclusivity or preference of the franchisee.

Royalties: Remuneration paid to the franchisor and the franchisee in return for the transfer of the franchise rights to the franchisee.

Advertising Fund: A fund in which all franchisees contribute to a given network specifically for enabling of marketing and advertising network that are common to all. This fund is administered by the franchisor, and may also have the participation of representatives of the franchisees.

Franchise Offering: Document required by the law of franchises. It should contain all necessary data and information to the prospective franchisee to analyze the investment opportunity in a particular franchise.

This contact information is included in most Franchise Disclosure Documents. In order to get a Franchise Disclosure Document or FDD as it is often referred to, you will have to complete a basic franchise application. The franchisor will then usually provide you with the FDD at that time. Included in that book of information is a list of the existing franchisees, the contract, the investment information etc... This information is required by Federal Law to be disclosed to your prior to making a purchase. So be sure to do your research and start with the Franchise Documents to get the initial information.
