Will The 48 Hour Opt Out Rule Remain In The UK

The UK is claimed to be the only country in the EU to extensively utilise the 48 hour voluntary agreement rule where by employees can opt out. Other EU countries feel that having this rule allows the UK an unfair economic advantage? They feel that opting out should be forbidden. This of course begs the question of how a rule that is available to all can be seen as an unfair advantage. You either choose to use it or not, just like playing to the offside rule in a football match really.

A compromise was thought to be agreed in the summer of 2008 which would have enabled the UK to keep the 48 hour working week opt out, but it would have been subject to an overall cap of 60 hours and no opt outs permitted during the first four weeks of employment. This would affect many employers as the opt out rule is utilised with immediate effect in many recruitment situations.

In December 2008 MEP's have voted once more in favour of abolishing the opt out exemption altogether (421 v 273) by 2011. The British government still wants to retain the opt out right and further consideration by the European Council of Ministers should take place in spring 2009. For those employers that make use of the opt out rule I think it is fair to say, "Expect some changes in the future".
