Do Not Call!

Since the federal 'Do Not Call' law came into effect, many of you have written, called or e-mailed asking what effect this new law will have on prospecting by telephone.

In addition to the new Federal law, more than 27 states currently have active state 'Do Not Call' registries. Many states will transfer their numbers from their state lists to the National 'Do Not Call' Registry, but some will not. Is this confusing? Yes!

This is my attempt to help readers make some sense out of these laws. Please remember—I'm not an attorney, none of this constitutes legal advice and you should definitely check everything out for yourself!

First of all, if you are a businessperson making calls to a place of business (i.e., business-to-business prospecting) you will not be affected at all. The state and federal laws do not apply to you. If, however, you are making calls to people in their homes (consumers) it is a whole different story.

When calling consumers, certain types of calls in the federal law are exempted, for example, if you are soliciting for a charitable organization or a political campaign or making some type of survey. Essentially, however, if you are calling consumers to sell something (and yes, unfortunately this includes setting appointments to potentially sell something) you must check the numbers you are calling against the federal registry. The federal registry was made available in September 2003 and there is a compliance manual available as well. If your state has a registry that is not included in the federal one, you'll have to check there too. In addition, if you call someone and they ask you not to call again—don't call them! You can call current customers or past customers, and you can also call people who have given you permission to call.

The 'Do Not Call' laws are a result of years of bad telemarketing by companies that rely only on volume of calls to reach their sales goals. It is a result of scams and dishonesty, and it is a reminder to all of us to always target your market, offer value and work from integrity!

These laws are unfortunate, because the people who are likely to be most affected are the small businesses and/or sole proprietors who are trying to connect with potential customers and offer real value. They will have the most problems with the rigmarole and expense of compliance. I suspect that many will try to refocus their markets on business-to-business.

Comapnies that release buggy software Comapnies that release buggy software - I know that companies have been doing this for a long time - rushing software into release and then sending out "patches" for the many problems they have later on, but I've never understood it. Surely the bad will they generate is enough to drive away customers?? Having said that, I've got Windows XP, it works just fine for me, and I see no point in changing. Call me an old fuddy duddy, but in my experience new software usually takes away stuff you loved about the old application, and puts in new stuff that you hate, because no one ever asks the users what they want...it's all done by techheads....or whatever the term for those guys is these days...

If someone joins then starts a new thread(s) right away with any sort of self-promotion in them, it's most likely a drive-by poster (spammer). This is especially true if they don't at least give an introduction first, or come back after a day or two and actually participate in the forum legitimately. Truly legitimate users don't do that stuff. Sometimes people make mistakes at first then end up being good members, but not often. This might sound mean but don't give any potential spammer the benefit of the doubt. FAR more often than not they will never become a useful member of the forum, so we don't want them here. I've been moderating several forums for the better part of a decade and I can tell you right now it's better to just delete a post you are unsure of rather than leave it. Chances are that if you have any doubts about it at all then it needs removed. Call me a hardass if you want, but I hate spammers!
Re: Review please Re: Review please - Remember that even only with some mild optimization your pages can do extremely well so long as you do good keyword research to start. Outside of optimization issues, your Web copy should be very focused on the reader and speak to the reader with dialog that focuses on the benefits to them. Try to avoid phrases or terms that are self focused. I refer to this style of writing nearly the same as writing for voice. (similar to how broadcasters write.) I would cut out the introductory lines of copy and get right to what you do, but always focusing your words to the reader using words like: (You can, you will, yours, you're, you can, instead of words like (we, we are, I am, we're, our, ours.) So for example instead of saying: "What we do different, is place your high resolution display ad right onto the surface of the table tops that hundreds of people eat at every day." You might try something like: Would it be useful to you as a local business owner in Nebraska to enjoy enormous local top exposure to thousands of viewers giving your business direct exposure for at least 3 months in a row? or for example... If you are business located in Nebraska, then imagine the potential of everyone in the community and all of the surrounding communities learning about your business around the family dinner table. Then hammer down some bullet point benefits for example: [*]Real world exposure through high resolution display ads [*]Your cost is less than a cent per exposure. [*]Reach literally thousands of prospects throughout Nebraska. [*]Unlike newspaper ads that only give a few seconds of exposure before the page is turned your ad will appear in front of every prospect for a minimum of 30 to 45 minutes guaranteed. [*]A very unique form of advertising that works exceptionally well. Happy smiling people with the right expression on their face (that of a happy advertiser) make good graphics. Pay attention to the expression in the eyes and have a photo of someone making good eye contact. Okay, I could give you some more tips, but these are a few things that help give you better results in the search engines and compel more readers to respond.
