What to Do if Your Business Received Notice of Inspection from ICE

If your business has received a Notice of Inspection & subpoenas for I-9 forms from ICE then you have three days to have the documents ready for ICE review. It is important to make an action plan to organize your group in such cases. These can be scary times but with the right plan and right people helping you will make it through. Below are four tips on what to do once you receive a NOI and subpoena from ICE. This should not be considered as a complete list and you should seek legal counsel.

1) Collect I-9 Forms

Make sure you have the I-9 forms, sometimes they want as far back as 3 years of former employees records.

2) Select an official ICE contact

Your company should appoint someone to be the official contact for ICE. Any other employee should kindly let ICE representatives know they should speak with the official company contact. This will save you an immense amount of headache. Make sure all contact is done in writing so to have records. It is best to look at #3 for who to select as the official company contact.

3) Find Immigration Lawyer

Besides knowing the law and having experience with these situations. An immigration lawyer can also make for the best official ICE contacts as as long as all the I-9 forms are received they can be picked up from the law firm and not your business.

4) Review I-9 Forms

You and your selected immigration lawyer should review all I-9 forms to make sure they they are accurate and complete. Speak with your attorney but in most cases it is not against the law to make corrections to to fix errors or incomplete paperwork. But do not create new forms after receiving the NOI.
